PREAMBLE
The establishments managed by Atypio Management (and listed on the atypio.com website) now offer a remote ordering service for catering.
Indeed, by means of a QR Code per hotel establishment / link to a dedicated website, the hotel guest can order/reserve services such as Room Service, Breakfast (...).
ARTICLE 1 - PURPOSE
These conditions govern the sale of these catering services to individual customers by each of the hotels managed by Atypio Management concerned.
ARTICLE 2 - PRICES
The rates indicated are in euros, including service, and take into account the VAT applicable on the day of the reservation, they do not extend per person or per item ordered - please refer to the description specified on the website dedicated to each hotel establishment.
The current VAT rates will be applied, depending on the type of service: i.e. 10% for food and non-alcoholic beverages, and 20 % for all alcoholic beverages and services.
Any change in the applicable rate, or any modification or introduction of new legal taxes by the competent authorities, will be automatically reflected in the prices indicated online and in the invoices.
It is hereby specified that catering and beverages not consumed as part of a package/package may not give rise to a reduction in price, whatever it may be. It is the responsibility of the client of the hotel establishment concerned to assess whether the price is suitable for him/her before booking (displayed on the dedicated website, in the establishment, provided on request by telephone or e-mail). No dispute concerning the price of the service can be taken into consideration at a later date.
The restaurant reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the rate in force at the time of validation of the order and subject to availability.
ARTICLE 3 - ORDERS
You can place your order via the link dedicated to each hotel establishment. This link is available on the establishment's own website (SAVOURER page), or, if applicable, on the information given in the Google description (see PHOTOS).
The contractual information is presented in French and will be confirmed at the latest at the time of validation of your order.
The ordering steps are as follows:
ATTENTION, the customer must order one type of meal per order (breakfast or lunch or dinner) in order to be able to specify the delivery time slot per order.
Order Breakfast
1. Click on the pack that is likely to suit you in terms of content/age (e.g. children's pack under 13, adult pack)
2. Read the associated description and if the pack suits you, click on the basket to add it to it
3. You will then have to specify the mandatory choices (e.g.: pack to go / delivered in room service; type of spread expected; type of hot drink (...))
4. You will also have to specify the desired delivery time slot (e.g. 07:00)
5. Then all the personal information required (surname, first name, room number if already known, telephone, email)
6. Once the order has been validated, the hotel receives it. It may validate the order if, and only if, it is complete and complies with the specific sales conditions specified on the website (for example: if a customer orders a breakfast to be delivered during a lunch or dinner time slot, the order will not be validated; similarly, if the customer orders a breakfast pack for an adult under 12 years of age).
Room Service Order
1. Click on the items that are likely to be relevant to you in terms of content/age (e.g. it is forbidden to order an alcoholic beverage by anyone under the age of 18
2. Read the associated descriptions and if you like the item(s) click on each item to add it to the basket
3. You will then have to specify the compulsory choices (example: to take away / delivered in room service (...))
4. You will also have to specify the desired delivery time slot (e.g. at 1pm)
5. Then all the personal information required (surname, first name, room number if already known, telephone, email)
6. Once the order has been validated, the hotel receives it. It may validate the order if, and only if, it is complete and complies with the specific sales conditions specified on the website (for example: if a customer orders only a glass of champagne in room service, this order will not be validated; in order to be validated, the customer must order a complete meal in room service, as the establishment is not able to order one glass at a time for the entire clientele at the rate indicated online).
Restaurant order
If the hotel establishment has, in addition to breakfast and room service, a sit-down restaurant, i.e. a bar-restaurant area, the menu of the bar-restaurant will be presented online, but it can only be consulted and not ordered online.
In summary, the hotel reserves the right not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulties concerning the order received with regard to the particular conditions of sale, compliance with the legislation in force, etc.
For all bookings of more than 10 people, the hotel will offer you a specific group service.
ARTICLE 4 - VALIDATION OF YOUR ORDER
Any order placed on the dedicated website of the hotel establishment beginning with https://clicks.tastycloud.fr/ XXXX implies acceptance of these General Terms and Conditions of Sale and the Special Terms and Conditions set out on the dedicated website. Any confirmation of an order therefore implies the customer's full and complete acceptance of these conditions, without exception or reservation. All the data provided and the recorded confirmation will be considered as proof of the transaction due. All customers declare that they are fully aware of these conditions.
The order confirmation (including a summary of the items ordered) sent by email following validation by the hotel will be considered as a signature and acceptance of the operations carried out and due.
ARTICLE 5 - PAYMENT
The fact of validating your order implies for you the obligation to pay the price indicated at the time of the pre-check-in or at the latest at the time of the check-out this being according to the decision of the hotel establishment. The hotel may require payment before delivery of the items ordered. The payment of your purchases will be made by the means of payment authorised by your hotel. The card will only be debited when the ordered items are delivered.
ARTICLE 6 - WITHDRAWAL
In accordance with the provisions of Article L.121-21 of the Consumer Code, you have a 14-day withdrawal period from the date of receipt of your order. If you exercise your right of withdrawal, the restaurant will reimburse the sums paid within 14 days following notification of your request and by the same means of payment as that used for the order.
EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
In accordance with the provisions of Article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to :
The supply of services which are fully performed before the end of the withdrawal period and the performance of which has begun after the consumer has given his prior express consent and expressly waived his right of withdrawal.
The supply of goods made to the consumer's specifications or clearly personalised.
The supply of goods that are likely to deteriorate or expire rapidly.
The supply of goods which, after delivery and by their nature, are inseparably mixed with other articles
ARTICLE 7 - APPLICABLE LAW IN CASE OF DISPUTES
The language of this contract is French. The present conditions of sale are subject to French law. In the event of a dispute, the French courts shall have exclusive jurisdiction.
ARTICLE 8 - INTELLECTUAL PROPERTY
All elements of the website dedicated to the hotel establishment concerned are and remain the exclusive intellectual property of the company holding the business of the hotel establishment concerned and of its internet partner TASTYCLOUD. No one is authorised to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site, whether software, visual or sound. Any simple link or hypertext link is strictly forbidden without the express written agreement of ATYPIO MANAGEMENT, TASTYCLOUD, the hotel establishment concerned or even the FRANCHISOR company partner of the said hotel establishment.
ARTICLE 9 - PERSONAL DATA
The hotel establishment, TastyCloud, and Atypio Management reserve the right to collect nominative information and personal data concerning you. This information is necessary for the management of your order, as well as for the improvement of the services and information that we send you.
It may also be transmitted to companies that contribute to this relationship, such as those responsible for the execution of services and orders for their management, execution, processing and payment.
This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations.
In accordance with the law of 6 January 1978, you have the right to access, rectify and object to personal information and data concerning you, directly on the website.
ARTICLE 10 - ARCHIVING EVIDENCE
TASTY CLOUD will archive the orders placed on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the French Civil Code. The computerised records of TASTY CLOUD shall be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.
ARTICLE 11 - PHOTOS
Each hotel establishment puts the catering products offered for sale online on the dedicated website https://clicks.tastycloud.fr/ XXXX. These products are illustrated by photos which may be generic, produced by the hotel establishment, by partners - suppliers (...). The said photos are not contractual. They are intended to illustrate and give an example.
